These Terms of Service (“Terms”) govern your use of the Axul Leads lead generation platform operated by Axul Solutions LLC (“we,” “us,” “our”), accessible at leads.axulsolutions.com. There are two types of users: Contractors (licensed home-service businesses that receive leads) and Homeowners (consumers who submit service requests). By using the platform, you agree to these Terms.
1. Description of Services
Axul Leads is a pay-per-lead platform that (a) markets to homeowners in defined service areas seeking home-improvement services; (b) collects and verifies homeowner service requests; and (c) delivers each verified request exclusively to one matched Contractor via a live, bridged phone call. If the Contractor does not answer, the platform retries automatically and delivers lead details via SMS as a backup.
Axul Leads is currently operating in the Atlanta, Georgia metropolitan area and may expand to additional markets over time.
2. Contractor Eligibility & Registration
To register as a Contractor, you must:
- Be a legally operating business entity or sole proprietor authorized to perform home-service work.
- Hold all licenses, permits, and insurance required by applicable law for the trades and service areas in which you accept leads.
- Provide accurate information about your business, trade(s), service area(s), and availability.
- Be at least 18 years of age.
You are solely responsible for maintaining your license and insurance in good standing. Axul Solutions LLC reserves the right to verify credentials and suspend or terminate any account that does not meet these requirements.
3. Lead Delivery & Exclusivity
Each lead is delivered to exactly one Contractor. Leads are never resold, shared, or auctioned to competing contractors. When a lead is routed to you:
- Your phone will ring. The call will announce it is a Axul Leads lead call before bridging you to the homeowner.
- Press 1 to accept and be connected to the homeowner live.
- If you do not answer, the platform will retry the bridge up to two additional times within five (5) minutes, then send lead details via SMS so you can follow up directly.
These automatic platform retries are separate from the follow-up attempts you make to reach the homeowner yourself (see the Lead Credit Policy in Section 5). Failure to answer a lead call does not entitle you to a credit. Keeping the calling hours, service area, and trade categories in your service agreement accurate is your responsibility.
4. Payment Terms & Subscriptions
4.1 Payment models
We offer the following ways to pay for leads. The model(s) available to you, and the applicable pricing, are discussed with you during an onboarding meeting and set out in your service agreement:
- Pay-per-lead. You are charged for each lead delivered to your phone line, regardless of whether the job is won. Pricing per lead varies by trade.
- Monthly subscription. A recurring monthly plan that may offer discounted per-lead pricing or a reserved lead volume.
- Lead allocation. A prepaid package for an agreed number of leads. We deliver the full allocation; allocations are fulfilled in their entirety.
4.2 Automatic renewal
If you enroll in a monthly subscription, it automatically renews each month, and your payment method will be charged the then-current subscription fee at the start of each billing cycle until you cancel.
By enrolling, you authorize these recurring charges. The renewal frequency and amount are disclosed to you at the time of purchase.
4.3 Cancellation
You may cancel a monthly subscription by sending written notice to admin@axulsolutions.com at least seven (7) days before your next billing cycle. Cancellation takes effect at the end of the current paid billing cycle: you keep access for the remainder of that cycle and will not be charged for the following cycle. Notice received fewer than seven (7) days before the next cycle takes effect at the end of that following cycle.
4.4 No refunds
Except for lead credits issued under Section 5, all payments are non-refundable. Subscription fees for the current billing cycle are not refunded upon cancellation. Lead allocations are non-refundable because the full allocation is delivered to you — there is no “unused” portion to refund.
4.5 Payment processing
All payments are processed via our third-party payment processor. By providing payment information, you authorize us to charge the amounts due. Invoices are generated automatically, and failed payments may result in suspension of lead delivery or your account.
5. Lead Credit Policy
You may request a credit for a lead within 48 hours of delivery if the lead meets one or more of the following criteria:
- The homeowner’s phone number is disconnected, invalid, or otherwise unreachable after the initial bridge and at least four (4) independent follow-up attempts.
- The lead is an exact duplicate of a lead delivered to your account within the prior 30 days (same phone number).
- The homeowner’s service address is outside the service area set out in your service agreement at the time the lead was delivered.
- The homeowner’s request is for a trade category not covered by your service agreement at the time of delivery.
Credits are not issued for leads where the homeowner is reachable but declines to proceed, where the job is won but later cancelled, or where the Contractor fails to answer the bridged call. Credits are applied to future invoices and are non-refundable as cash.
Credits are capped at 10% of total leads delivered in any given billing month. Disputes that would exceed this threshold in a single month will be reviewed on a case-by-case basis at our discretion.
To request a credit, contact us at admin@axulsolutions.com within the 48-hour window, with the lead ID and reason for the dispute.
6. TCPA Compliance & Calling Obligations
Axul Solutions LLC obtains express written consent from each homeowner before delivering their information to a Contractor, in compliance with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and applicable FCC regulations. Consent records (including the consent text presented, timestamp, and IP address) are retained for a minimum of four (4) years.
The initial bridged call made by Axul Leads is covered by that consent. However, any independent follow-up calls or texts you send to a homeowner after receiving the lead are your sole responsibility. You must:
- Comply with the TCPA, the FTC’s Telemarketing Sales Rule (TSR), and all applicable state and local calling regulations for every call or text you initiate.
- Only contact homeowners during TCPA-permissible hours (8:00 a.m. to 9:00 p.m. local time of the called party).
- Honor do-not-call (DNC) requests immediately and maintain your own internal DNC list.
- Not send automated or prerecorded messages without separate express written consent from the homeowner.
You agree to indemnify and hold Axul Solutions LLC harmless from any claims, fines, or penalties arising from your independent calling or texting practices.
7. Call Recording
Calls bridged through the Axul Leads platform may be recorded for quality assurance, compliance verification, dispute resolution, and platform improvement purposes. By accepting a bridged call, both the Contractor and the homeowner consent to such recording. Recordings are retained for up to twelve (12) months and may be reviewed in connection with a lead credit dispute or compliance investigation.
8. Contractor Conduct
As a Contractor, you agree to:
- Treat homeowners professionally and in accordance with applicable consumer protection laws.
- Not resell, share, or transfer homeowner lead information to any third party.
- Keep the details in your service agreement (calling hours, service area, trade categories) current and accurate by notifying us of any changes at admin@axulsolutions.com.
- Not attempt to circumvent the Axul Leads platform by soliciting homeowners to cancel and re-submit requests outside the platform.
- Not use lead information for any purpose other than fulfilling the homeowner’s service request.
9. Prohibited Uses
You may not use the platform to:
- Violate any applicable law or regulation.
- Submit false, fraudulent, or fabricated service requests.
- Interfere with or disrupt the platform’s operation or security.
- Attempt to gain unauthorized access to any account, system, or network.
- Use automated scripts to scrape, test, or abuse the lead routing system.
- Misrepresent your identity, credentials, or service area.
10. Intellectual Property
The Axul Leads platform, website, and all associated content (including text, graphics, logos, and software) are owned by Axul Solutions LLC or its licensors. We grant you a limited, non-exclusive, non-transferable license to access and use the platform for its intended purpose. Nothing in these Terms transfers any ownership rights to you.
11. Disclaimers
The platform and all leads are provided “as is.” Axul Solutions LLC makes no warranty, express or implied, regarding lead quality, conversion rates, job value, homeowner intent, or any specific business outcome. We do not guarantee a minimum number of leads, continuous platform availability, or error-free operation.
12. Limitation of Liability
To the maximum extent permitted by law, Axul Solutions LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, leads, or business opportunity, arising out of or related to your use of (or inability to use) the platform, even if advised of the possibility of such damages. Our total aggregate liability to you for any claim arising under these Terms shall not exceed the total fees you paid to us in the 30 days preceding the event giving rise to the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless Axul Solutions LLC and its officers, employees, and agents from and against any claims, liabilities, damages, losses, fines, penalties, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the platform; (b) your violation of these Terms; (c) your independent calling or texting practices; (d) your failure to maintain required licenses or insurance; or (e) any dispute between you and a homeowner.
14. Term & Termination
These Terms remain in effect while you use the platform. Either party may terminate the Contractor relationship at any time. We may suspend or terminate your account immediately for violation of these Terms, non-payment, or any conduct that we determine, in our sole discretion, is harmful to homeowners, other Contractors, or the platform.
Upon termination, your right to access the platform ceases. Sections 6, 7, 10, 11, 12, 13, and 15 survive termination.
15. Governing Law & Dispute Resolution
15.1 Governing law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles. If you are a Homeowner using the platform as a consumer, this does not deprive you of any mandatory consumer protections guaranteed by the laws of your state of residence.
15.2 Informal resolution first
Before starting an arbitration, both parties agree to first attempt to resolve any dispute through good-faith negotiation. If the dispute is not resolved within thirty (30) days of written notice, either party may proceed to arbitration as set out below.
15.3 Arbitration for Contractors
Disputes between Axul Solutions LLC and a Contractor shall be resolved by binding arbitration administered in Sheridan County, Wyoming, under the Commercial Arbitration Rules of the American Arbitration Association (AAA). Judgment on the award may be entered in any court of competent jurisdiction.
15.4 Arbitration for Homeowners (consumers)
Disputes between Axul Solutions LLC and a Homeowner shall be resolved by binding arbitration administered under the AAA Consumer Arbitration Rules. Any in-person hearing will take place in the county of the Homeowner’s residence, and the Homeowner may instead elect to participate by telephone or videoconference. Axul Solutions LLC will pay the arbitration filing, administrative, and arbitrator fees to the extent required by the AAA Consumer Arbitration Rules.
Small claims exception. Either party may bring an individual claim in a small claims court of competent jurisdiction instead of arbitration, so long as the matter remains in that court and on an individual (non-class) basis.
15.5 Class action and jury trial waiver
To the maximum extent permitted by law, all disputes will be arbitrated only on an individual basis. You and Axul Solutions LLC waive any right to a jury trial and any right to bring or participate in a class, collective, consolidated, or representative action. The arbitrator may not consolidate more than one person’s claims or preside over any form of class or representative proceeding.
15.6 30-day right to opt out of arbitration
You may opt out of this arbitration agreement (Sections 15.2 through 15.5) by sending written notice to admin@axulsolutions.com within thirty (30) days of first accepting these Terms or first using the platform, whichever is earlier. Your notice must include your full name and the phone number or account associated with your use of the platform. Opting out affects only the arbitration agreement; all other provisions of these Terms remain in effect.
15.7 Injunctive relief
Nothing in this Section prevents either party from seeking injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
16. Changes to These Terms
We may update these Terms at any time. The “Last updated” date at the top of this page reflects the most recent revision. We will notify active Contractors of material changes via email. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.
